|
| 0013: | her Assigns for and during the term of her
|
| 0014: | natural life And from and immediately after the
|
| 0015: | decease of her my said Wife Then I give and

| 0016: | devise the same Messuage or Tenement Hereditaments

| 0017: | and Premises with the Appurtenances unto my

| 0018: | Daughter Sarah Hollier and my Friend Joseph

| 0019: | Rackstraw of Henley upon Thames aforesaid Grocer

| 0020: | their Heirs and Assigns To hold the same unto and

| 0021: | to the use of them my said Daughter [↑Sarah] and the said

| 0022: | Joseph Rackstraw their Heirs and Assigns for ever

| 0023: | [left blank] upon such Trusts and to and
|
| 0024: | for such intents and purposes as are herein

| 0025: | after mentioned expressed and declared of and concerning

| 0026: | the same (that is to say) Upon Trust that they
|
| 0027: | the said Sarah Hollier and Joseph Rackstraw or the
|
| 0028: | Survivor of them or the Heirs and Assigns of such
|
| 0029: | Survivor do and shall with all convenient speed
|
| 0030: | after the decease of my said Wife sell and dispose
|
| 0031: | of the same either by Public Auction or Private
|
| 0032: | Contract for the most Money and best Price that
|
| 0033: | can or may be reasonably had or gotten for the
|
| 0034: | same And I direct that the Money arising by and
|
| 0035: | from such Sale shall sink into and become a part
|
| 0036: | of the Residue of my Personal Estate herein after
|
| 0037: | bequeathed And it is my Will and I do hereby
|
| 0038: | declare that upon Payment of the Money to arise
|
| 0039: | by such Sale of the said Messuage or Tenement
|
| 0040: | and Premises as aforesaid it Shall and may be
|
| 0041: | lawful to and for my said Trustees and the Survivor
|
| 0042: | of them and the Heirs and Assigns of such Survivor
|
| 0043: | to give and sign Receipts for the Money to arise
|
| 0044: | or be received by such Sale or Sales which Receipt
|
| 0045: | or Receipts shall be a sufficient discharge or discharges
|
| 0046: | to any Purchasor or Purchasors for the Purchase
|
| 0047: | Money for which the said Messuage or Tenement
|
| 0048: | Hereditaments and Premises or any part thereof
|
| 0049: | shall be sold or for so much as in such Receipt
|
| 0050: | or Receipts shall be expressed or Acknowledged to be
|
| 0051: | received And such Purchasor and Purchasors and
|
| 0052: | his or their Heirs Executors Adm[inistrar]ors or Assigns shall

| 0053: | not afterwards be answerable or accountable for any
|
| 0054: | loss misapplication or non application of the said
|
| 0055: | purchase money or be obliged to see to the application
|
| 0056: | thereof or any part thereof Also I give & bequeath

| 0057: | unto my said Daughter Sarah Hollier her Executors

| 0058: | and Administrators the Sum of Five hundred Pounds

| 0059: | of lawful Money of Great Britain And as to all the
|
| 0060: | rest residue and remainder of my Personal Estate

| 0061: | and Effects whatsoever and wheresoever and of what

| 0062: | nature or kind soever not herein before by me

| 0063: | disposed of I give bequeath and dispose of the same

| 0065: | bequeath the same to the said Sarah Hollier and

| 0066: | Joseph Rackstraw [↑their Executors and Administrators]

| 0067: | upon the Trusts following viz. Upon

| 0068: | Trust to permit and suffer or otherwise sufficiently

| 0069: | authorize and empower my said Wife Mary Hollier
|
| 0070: | to have the use of my Household Furniture and
|
| 0071: | to receive and take the Income Interest Dividends
|
| 0072: | and Produce of the other Part of my said Personal
|
| 0073: | Estate for and during the term of her natural life
|
| 0074: | to and for her own use and benefit And from
|
| 0075: | and after her decease Then as to one Moiety or
|
| 0076: | equal half Part thereof the whole into two equal
|
| 0077: | parts to be divided of and in the said Residue I
|
| 0078: | give the same unto my said Daughter Sarah

| 0079: | Hollier and Joseph Rackstraw their Executors and
|
| 0080: | Adm[inistrat]ors Upon the several Trusts and to and for the
|
| 0081: | several Ends Intents and Purposes following (that is

| 0082: | to say) Upon Trust to convert the same into ready
|
| 0083: | Money and to place [↑out and invest] the same in their Names

| 0084: | in the Public Funds or on Real or Government
|
| 0085: | Securities not being Annuities for lives or determinable
|
| 0086: | at any certain Term or Number of Years and to
|
| 0087: | Pay and apply the Income Interest Dividends and
|
| 0088: | Produce thereof unto my Daughter Ann Westbrook
|
| 0089: | Wife of Mr John Westbrook of the Parish of Cookham
|
| 0090: | in the County of Berks and her Assigns for and
|
| 0091: | during the term of her natural life to and for her
|
| 0092: | own sole and separate use and benefit separate
|
| 0093: | and apart from her said Husband and I will and
|
| 0094: | direct that the same shall not be chargeable
|
| 0095: | with or liable to the Debts Controul or Engagement
|
| 0096: | of her present or any future taken Husband but
|
| 0097: | that her Receipt alone notwithstanding her Coverture
|
| 0098: | shall from time to time notwithstanding her
|
| 0099: | Coverture shall from time to time be a good and
|
| 0100: | sufficient discharge to my said Trustees for the
|
| 0101: | same and from and after the decease of my said
|
| 0102: | Daughter Ann Westbrook Then upon Trust to assign
|
| 0103: | transfer and divide the same between and amongst
|
| 0104: | all and every the Child and Children of her my
|
| 0105: | said Daughter Ann Westbrook which shall be living

| 0106: | at the time of her decease when and as they
|
| 0107: | shall respectively attain their Ages of twenty one

| 0108: | Years equally share and share alike But in case
|
| 0109: | any or either of my said Grand children shall
|
| 0110: | happen to die before his her or their attaining their
|
| 0111: | said Ages of twenty one Years Then I give and
|
| 0112: | bequeath the share or shares of him her or them
|
| 0113: | so dying unto and amongst the Survivors and
|
| 0114: | Survivor of them to be equally divided between them
|
| 0115: | share and share alike when and as their original
|
| 0116: | share or portion of the said Trust Money shall
|
| 0117: | respectively become due and payable But in case
|
| 0118: | all my said Grand Children shall happen to die
|
| 0119: | under the Age of twenty one Years Then I give
|
| 0120: | and bequeath the same unto my said Daughter
|
| 0121: | Sarah her Executors Adm[inistrat]ors or Assigns for ever to

| 0122: | and for her and their own use and benefit And
|
| 0123: | in the meantime and until my said Grandchildren

| 0124: | shall attain their said Ages of twenty one Years

| 0125: | Upon Trust to pay and apply the Income Interest

| 0126: | Dividends and Produce of the said Trust Monies for

| 0127: | and towards the Maintenance Education and bringing
|
| 0128: | up of my said Grandchildren respectively and to for

| 0129: | and upon no other use trust intent or purpose

| 0130: | whatsoever And as to the other undivided Moiety

| 0131: | or equal half part of the Residue of my said personal

| 0132: | Estate I give and bequeath the same unto my

| 0133: | said Daughter Sarah Hollier her Executors Adm[inistrat]ors and

| 0134: | Assigns to and for her and their own use and
|
| 0135: | benefit And I do hereby nominate constitute and appoint

| 0136: | my said Daughter Sarah Hollier and the said Joseph

| 0137: | Rackstraw Executrix and Executor of this my Will And I

| 0138: | do hereby Will direct and declare that they my said

| 0139: | Trustees and Executors or either of them their or either of
|
| 0140: | their Heirs Executors or Adm[inistrat]ors shall not be charged or

| 0141: | chargeable with or accountable for any more of the said
|
| 0142: | Trust Monies and Estate than she he or they shall
|
| 0143: | respectively actually receive or shall come to their any
|
| 0144: | or either of their respective hands by virtue of this
|
| 0145: | my Will nor for any loss that may happen to the
|
| 0146: | same either by placing the same at Interest or
|
| 0147: | otherwise howsoever so as such loss happen without
|
| 0148: | his her or their respective wilful neglect or default nor
|
| 0149: | shall my said Trustees or Executors or either of them

| 0150: | be answerable or accountable for the Acts Deeds Receipts

| 0151: | or payments of the other of them but each of them
|
| 0152: | for his or her own separate Acts Deeds Receipts and
|
| 0153: | Payments only And also that it shall and may
|
| 0154: | be lawful to and for my said Trustees and the

| 0155: | Survivor of them and the Heirs Executors and Adm[inistrat]ors

| 0156: | of such Survivor to deduct detain and reimburse to
|
| 0157: | themselves herself and himself respectively all such
|
| 0158: | loss Costs Charges and Expences as she he or they

| 0159: | shall pay expend sustain or be put unto by reason

| 0160: | of the performance of this my Will or the Trusts hereby
