| 0012: | I will and direct that my Just debts Funeral and

| 0013: | Testamentary Expences shall be fully paid and satisfied

| 0014: | also I Give and Bequeath to my Man servant and Maid

| 0015: | servant the sum of two Guineas each for Mourning

| 0016: | also I Give and Bequeath unto my loving Brothers

| 0017: | the Reverend Matthew Nicholas Doctor in Divinity

| 0018: | and the Reverend Robert Nicholas Clerk and to my

| 0019: | beloved sister Ann Nicholas and to the Reverend

| 0020: | Thomas Heath of Lavant in Sussex all the Rest Residue

| 0021: | and Remainder of my ready Money Securities for Money

| 0022: | Debts owing to me and all other my Personal Estate
|
| 0023: | whatsoever and wheresoever and of what nature or kind

| 0024: | soever upon the several Trusts nevertheless hereinafter

| 0025: | mentioned expressed and declared of and concerning the

| 0026: | same (that is to say) upon Trust that they my said

| 0027: | Trustees or the survivor of them or the Executors or

| 0028: | Administrators of such survivor do and shall as soon as

| 0029: | conveniently may be after my decease collect and get

| 0030: | in my said personal Estate and Invest the Money

| 0031: | arising therefrom either at Interest on some real

| 0032: | Securities or in the publick Funds or Government

| 0033: | Securities not being annuities for lives [↑or] determinable

| 0034: | at any certain term or Number of years and do and

| 0035: | shall from time to time Pay Apply and Dispose of the

| 0036: | Income Interest Dividends and Profits thereof unto and

| 0037: | for the use and benefit of Sarah Nicholas John

| 0038: | Nicholas and James Nicholas Children of John Nicholas

| 0039: | late of Lavant in the County of Sussex deceased

| 0040: | who was formerly servant to the said Reverend Mr

| 0041: | Heath in such manner and form as they my said
|
| 0042: | Trustees or any two of them or the survivor of them
|
| 0043: | or the Executors or Administrators of such Survivor
|
| 0044: | shall think proper and also do and shall pay distribute
|
| 0045: | and divide the whole of the Principal Money so
|
| 0046: | arising from my said personal Estate or Assign and
|
| 0047: | Transfer the stocks and securities in which the same
|
| 0048: | shall be invested unto and amongst the said Sarah
|
| 0049: | Nicholas John Nicholas and James Nicholas in such
|
| 0050: | parts shares and proportions and at such time and
|
| 0051: | times and in such manner and form as they my
|
| 0052: | said Trustees or any two of them or the survivor of
|
| 0053: | them my said Trustees his or her Executors or adm[inistrat]ors
|
| 0054: | shall think proper and I do hereby Will and direct that
|
| 0055: | it shall and may be lawful to and for my said Trustees
|
| 0056: | from time to time in the first place to retain and
|
| 0057: | deduct to themselves respectively all such Costs Charges
|
| 0058: | and Expences as they any or either of them shall be put
|
| 0059: | unto in the Execution of the Trust hereby in them
|
| 0060: | reposed and that they my said Trustees any or either
|
| 0061: | of them shall not be Answerable or accountable for
|
| 0062: | any more of the said Trust Moneys and Effects than
|
| 0063: | shall come to their hands respectively nor with or for
|
| 0064: | any loss that may happen to the same at Interest
|
| 0065: | or otherwise so as such loss happen without their
|
| 0066: | Wilful Neglect or default respectively neither shall
|
| 0067: | my said Trustees any or either of them be answerable
|
| 0068: | or accountable the one of them for the other of them
|
| 0069: | or for the Acts Receipts defaults or Payments the one
|
| 0070: | of each other but each for his and her own acts
|
| 0071: | Receipts defaults and payments only and I do hereby
|
| 0072: | Nominate Constitute and appoint my Daughter in Law
|
| 0073: | Mrs Mary Toovey and my good Friend Mr John Hill
|
| 0074: | of Henley upon Thames aforesaid Postmaster Executrix
|
| 0075: | and Executor of this my Will hereby requesting them
|
| 0076: | to dispose of such Household Goods and Effects as belong
|
| 0077: | to me and Collect in my debts and after paying
|
| 0078: | thereout my Just debts and deducting the expences
|
| 0079: | they shall be put unto to pay the clear Monies
|
| 0080: | arising therefrom into the Hands of my
|
| 0081: | Trustees herein before named and to assign to
|
| 0082: | them all such Monies as I shall have on securities
|
| 0083: | or in the Funds to be by my said Trustees
|
| 0084: | applied upon the Trusts in my Will before mentioned

| 0085: | and I do hereby further Will and direct that the
|
| 0086: | Receipt of my said Trustees or any two of them
|
| 0087: | shall be a good discharge to my said Executors for
|
| 0088: | all Monies they shall so pay them and that my
|
| 0089: | said Executors shall be no further accountable
|
| 0090: | for the same and that they my said Executrix
|
| 0091: | and Executor shall not be answerable or accountable
|
| 0092: | for each other or for the Acts Deeds Receipts or
|
| 0093: | Payments of each other but each for his and her
|
| 0094: | own acts deeds receipts and Payments only and
|
| 0095: | Lastly I do hereby revoke and make Void all

| 0096: | former and other Will and Wills by me at

| 0097: | any time heretofore made and do declare this
