| 0005: | this my last Will and Testament in manner and form following
|
| 0006: | (that is to say) First I give and bequeath my Soul to

| 0007: | Almighty God who gave it and my Body I commit to the

| 0008: | Earth to be decently Interred at the discretion of my Executors

| 0009: | herein after named and as to my Worldly Estate and Effects

| 0010: | wherewith it hath pleased God to bless me I dispose thereof

| 0011: | as follows First I will and direct that all my just Debts

| 0012: | and Funeral Expences shall be fully paid and satisfied

| 0013: | And I do hereby charge all my Real and Personal Estates

| 0015: | is very amply provided for by the Will of my late Cousin

| 0016: | Henry Mason late of Stoken Church in the County of

| 0017: | Oxford Esquire deceased Now I do hereby give and bequeath

| 0018: | Unto him him my said Son Thomas Mason the sum of twenty

| 0019: | Pounds only for Mourning Also I give devise and

| 0020: | bequeath unto my beloved Wife Ellen Mason one Annuity
|
| 0021: | Yearly Rent Charge or sum of one hundred Pounds of
|
| 0022: | lawful Money of Great Britain to be Yearly Issuable and
|
| 0023: | payable to her free and clear of and from all Taxes
|
| 0024: | Parliamentary or others and all other charges and deductions
|
| 0025: | whatsoever out of all my Real and Personal Estates
|
| 0026: | herein after given and bequeathed to my Sons John
|
| 0027: | Mason and Richard Mason and my Daughters Elizabeth
|
| 0028: | Mason and Ann Mason by equal quarterly payments
|
| 0029: | on the four most usual quarterly days of payment in
|
| 0030: | the Year that is to say the Feast of the Annunciation
|
| 0031: | of the Blessed Virgin Mary the Feast of Saint John the
|
| 0032: | Baptist the Feast of Saint Michael the Arch Angel and
|
| 0033: | the Birth of our Lord Christ the first payment thereof to
|
| 0034: | begin and be made on such of the said Feasts as shall
|
| 0035: | first and next happen after my decease And I do hereby
|
| 0036: | charge and subject all and every the said Real and Personal
|
| 0037: | Estates herein after devised to my said Sons John Mason
|
| 0038: | and Richard Mason and my said Daughters Elizabeth
|
| 0039: | Mason and Ann Mason with and to the payment of
|
| 0040: | the said Annuity Yearly Rent charge or sum of one
|
| 0041: | hundred Pounds accordingly And my Will is that in case
|
| 0042: | the same Annuity Yearly Rent Charge or sum of one
|
| 0043: | hundred Pounds or any part thereof shall be behind or
|
| 0044: | unpaid by the space of thirty days next over [↑or] after any

| 0045: | or either of the said Feasts or Days whereon the same

| 0046: | ought to be paid as aforesaid being lawfully demanded

| 0047: | that then and so often it shall and may be lawful to

| 0048: | and for my said Wife Ellen Mason to enter upon all

| 0049: | and every or any part of the said Premisses charged
|
| 0050: | therewith as aforesaid and distrain for the same or
|
| 0051: | so much thereof as shall be so in Arrear and all
|
| 0052: | Costs and Charges occasioned by non payment thereof
|
| 0053: | Also I give devise and bequeath unto them my said

| 0054: | Sons John Mason and Richard Mason and my said
|
| 0055: | Daughters Elizabeth Mason and Ann Mason All and

| 0056: | every my Freehold Leasehold and Copyhold Messuages

| 0057: | Lands Tenements and Hereditaments and also all other my
|
| 0058: | Real and Personal Estates and Effects whatsoever and
|
| 0059: | wheresoever not herein before given or bequeathed and
|
| 0060: | chargeable as aforesaid To Hold the same unto and to the
|
| 0061: | use of my said Sons John Mason and Richard Mason
|
| 0062: | and my said Daughters Elizabeth Mason and Ann Mason

| 0063: | their Heirs Executors Administrators and Assigns equally
|
| 0064: | to be divided between them share and share alike as
|
| 0065: | Tenants in common and not as joint Tenants And I do
|
| 0066: | hereby Nominate Constitute and Appoint them my said
|
| 0067: | Sons John Mason and Richard Mason Executors of this
|
| 0068: | my Will And I do hereby authorize impower and direct
|
| 0069: | my said Executors and the Survivor of them his Heirs
|
| 0070: | Executors and Administrators in the mean time from and
|
| 0071: | after my decease until my said Daughter Ann Mason
|
| 0072: | shall attain her Age of twenty one Years to Manage
|
| 0073: | and Improve the Estate and Fortune of her my said
|
| 0074: | Daughter Ann Mason for her use and benefit and to
|
| 0075: | Lease all or any part of her Freehold Copyhold or
|
| 0076: | Leasehold Estates and to lend or place out upon Security
|
| 0077: | or Securities at Interest or to lay out in the publick
|
| 0078: | Companies or Funds or otherwise to improve according
|
| 0079: | to his or their discretions all or any part of the Monies
|
| 0080: | belonging to my said Daughter Ann or arising from
|
| 0081: | her said Estates and Fortune and to pay unto and
|
| 0082: | account with her for all such Rents Interest Produce
|
| 0083: | and Improvements as shall arise from or be made
|
| 0084: | of or produced by her said Estates Monies and Fortune
|
| 0085: | when she shall attain her Age of twenty one Years
|
| 0086: | And my Will is And I do hereby expressly declare that
|
| 0087: | my said Executors and Trustees or either of them their
|
| 0088: | or either of their Executors or Administrators shall
|
| 0089: | not be charged or chargeable with or accountable for
|
| 0090: | more of the aforesaid Monies and Estates than he or
|
| 0091: | they shall actually receive or such come to his or
|
| 0092: | their respective Hands by virtue of this my Will nor
|
| 0093: | with or for any Loss which may happen to the said
|
| 0094: | Monies and Estates of my said Daughter Ann or any
|
| 0095: | part thereof so as such loss happen without their
|
| 0096: | wilful default nor the one of them for the other
|
| 0097: | of them or for the Acts Deeds Receipts Defaults or

| 0098: | payments the one of the other And also that it shall
|
| 0099: | and may be lawful to and for my said Executors and
|
| 0100: | each of them their and each of their Executors and
|
| 0101: | Administrators in the first place by and out of the
|
| 0102: | Premisses respectively to deduct and reimburse him

| 0103: | and themselves respectively all such loss Costs charges

| 0104: | and Expences as he or they or any of them shall
|
| 0105: | sustain expend or be put unto for or by reason of
|
| 0106: | the performance of this my Will or the Trust hereby

| 0107: | in them reposed or the Management or Execution

| 0108: | thereof respectively or any other thing in any wise

| 0109: | relating thereunto And Lastly I do hereby revoke and
