To: Mary Bacon (Daughter)

I give to Thomas Simmonds of Turville Court, and Edmund Taylor of Stoken Church, timber, all my estate and also all my householdĀ  goods, linen, china, plate, jewels, ready money, securities for money and all my other personal estateĀ  upon trust that they shall after my death dispose of my assets, and after discharging my debts and paying the legacies, to invest the balance in funds or securities in their name and to pay the income and dividends to my daughter Mary Bacon, wife of Stephen Bacon, to and for her sole use during her lifetime, and not to her husband. If my daughter does not survive her present husband, then upon further trust to pay the income for the education of any child(ren) as she may have by her present husband and as soon any child(ren) shall attain the age of twenty one years, then to pay the child(ren) such proportion of the principle money as my said trustee(s) shall possess to and for the child's or children's own use and benefit. If my daughter survives her present husband then this present trust shall cease and be utterly void and my daughter, her executors, administrators or assignees, shall become entitled to my estate for her and their own proper use and benefit free from further trust.

0006: and Memory Praised be God for the same and being
0007: desirous to settle my Worldly Affairs whilst I have
0008: strenghth and capacity so to do do make and publish
0009: this my last Will and Testament in manner following
0010: hereby revoking and making void all former Wills by me
0011: at any time heretofofore made And first and principally
0012: I commit my Soul into the Hands of Almighty God
0013: who gave it and my Body to the Earth to be decently
0014: buried at the discretion of my Executors herein after
0015: named And as to my Worldly Estate which it has

0028: they the said Thomas Simmonds and Edmund Taylor and
0029: the Survivor of them his Executors and Administrators
0030: shall and do as soon as conveniently may be after
0031: my decease sell and dispose of the same and every
0032: part thereof and convert the same into ready Money
0033: and the Money arising therefrom in the first place to
0034: pay and discharge all my just Debts and Funeral
0035: Expences and also the Legacies herein by me bequeathed
0036: and the residue of the said Money thereof to place out
0037: in the public Funds or some other Government Securities
0038: in the Name of them the said Thomas Simmonds and
0039: Edmund Taylor or the Survivor of them his Executors
0040: or Administrators upon the further trusts herein after
0041: mentioned that is to say upon trust to apply and
0042: pay the Dividends Interest and Produce thereof from
0043: time to time as the same shall become due and payable
0044: unto my Daughter Mary Bacon wife of Stephen Bacon
0045: to and for her sole and separate use for and during
0046: the term of her natural Life And that the same or
0047: any part thereof shall not be paid to her said
0048: Husband nor shall the same or any part thereof
0049: be subject charged or liable to the controul debts
0050: or engagements of her said Husband and the Receipts
0051: of her my said daughter notwithstanding her coverture
0052: shall be sufficient discharges to my said Trustees or
0053: Trustee on paying the same And in case my said
0054: daughter shall not survive her present Husband the
0055: said Stephen Bacon then upon further trust to pay and
0056: apply the dividends Interest and Produce thereof to and
0057: for the Education of such Child and Children as she my
0058: said Daughter may have by her present Husband
0059: and as soon as such Child or Children or such of
0060: them shall attain the Age of twenty one Years then
0061: to pay such Child or Children as shall attain such
0062: Age of twenty one Years such Childs proportion of
0063: the principle Money as my said Trustees or Trustee
0064: shall be possessed of by virtue of this my Will to and
0065: for such Childs own use and benefit provided
0066: nevertheless and my Will and meaning is in case my
0067: said Daughter shall survive her present Husband
0068: that then this present trust shall cease and be utterly
0069: void And that she my said Daughter her Executors
0070: Administrators or Assigns shall stand seized and possessed
0071: of the same and every part thereof to and for her and
0072: their own proper use and benefit free from any further
0073: trust any thing herein contained to the contrary in
0074: any wise notwithstanding Also I give and bequeath
0075: unto my Son in Law the said Stephen Bacon five pounds
0076: to be paid him within six Months after my decease
